Terms of Use
Last updated 21 August 2026
1. What HortOS is
HortOS is a wholesale trade platform that connects plant buyers (landscapers, developers, councils, retailers and other trade businesses) directly with production nurseries. HortOS is a venue: every sale is a direct transaction between the buyer and the grower. HortOS is not the seller, is not a party to any order, and does not handle payment. Payment, delivery and any credit terms are settled directly between buyer and grower.
2. Trade only
HortOS is for business use. A business identifier (Company number) is required to place orders or claim a grower profile, and it is shown to the growers you order from. It is not a retail store and is not open to the general public.
3. Listings, prices and availability
Listings show each grower's availability as declared by the grower or as published in their circulated availability lists. Nursery stock changes daily: prices (ex VAT), sizes and quantities are indicative until a grower accepts your order. A listing can change or disappear at any time without notice. Each listing shows when it was last updated.
4. Orders
Placing an order sends a request to the grower. No contract exists until the grower accepts. Growers may propose substitutions, adjust quantities or decline. Once accepted, the order is between you and the grower on the grower's usual trade terms, including their cancellation and returns policy.
5. Grower profiles and claims
Growers appear on HortOS because their availability is circulated in the trade. Any grower can claim their profile free of charge, and once claimed has full control of their listings, prices, visibility and contact details. A grower can correct or remove their profile at any time - see the growers page or contact us. Orders are emailed to the grower's ordering address in full; accepting an order from that email creates the grower's HortOS account on the same address and counts as claiming the profile. Claiming a profile you are not authorised to manage is prohibited.
6. Accounts
Sign-in is by email link. You are responsible for the security of your email account and for activity under your account. We may suspend accounts used to abuse the platform, misrepresent a business, spam growers or scrape data.
7. Acceptable use
Do not: harvest or bulk-scrape the catalogue; misrepresent your identity, business or Company number; place orders you do not intend to complete; interfere with the platform's operation; or use another business's claim link or order links.
Automated access and data use: the grower directory, contact details, listings and prices are compiled and maintained by HortOS and its growers. Text and data mining rights are reserved (every response carries a TDM-Reservation header and /llms.txt states the policy). Crawling, copying or extracting the data in bulk, by any means, for any purpose including training models or building another directory, is not permitted without written permission. Legitimate trade tools can request read access to the HortOS API through team@hortosapp.com. Listings carry provenance and canary records, so copies are traceable.
8. Liability
HortOS is provided free and as-is. We do not guarantee that any listing is accurate, that any grower will accept an order, or that the platform will be uninterrupted. Nothing in these terms excludes rights that cannot be excluded under the Consumer Rights Act 2015 (United Kingdom). To the maximum extent permitted by law, we are not liable for the acts or omissions of growers or buyers, for plant quality or supply, or for indirect or consequential loss arising from use of the platform.
9. Changes
We may update these terms as the platform evolves; the date above always reflects the current version. Continued use after a change is acceptance of the updated terms. These terms are governed by the laws of Queensland, Australia, where HortOS is operated from; the United Kingdom service is provided to trade businesses on that basis.
